As of July 2025, OSHA’s Heat Injury and Illness Prevention Standard remains in the rulemaking process. Here’s the latest:
Public Hearing Concludes, Comments Still Open
On July 2nd, 2025, OSHA concluded its informal public hearing after several days of testimony and stakeholder discussion. Individuals and organizations that submitted a Notice of Intention to Appear may now participate in the post-hearing comment period, which is open until September 30, 2025. OSHA may revise the proposed rule based on feedback received during this time. A final rule could be published as early as late 2025 or early 2026.
What the Proposed Rule Includes
Initially released in July 2024, the proposed standard is designed to protect workers from heat-related injuries and illnesses in both indoor and outdoor environments. It applies to general industry, construction, maritime, and agriculture, with limited exceptions.
Key provisions include:
- A requirement for a written Heat Injury and Illness Prevention Plan (HIIPP)
- Monitoring the heat index on days when temperatures exceed 80°F
- Additional protective measures on days over 90°F, including:
- Access to drinking water
- Shaded or cooled rest areas
- Employee training on heat risks and prevention
Enforcement Continues Through Existing Measures
Even though the rule is not yet finalized, OSHA is actively enforcing heat safety under its National Emphasis Program and the General Duty Clause. Employers can still be cited if they fail to provide a workplace free of recognized heat-related hazards that could cause serious harm or death.

Now is the time to proactively evaluate your heat safety policies. Even in the absence of a finalized federal standard, OSHA is watching. Employers should begin building or refining their heat illness prevention plans to reduce liability, protect workers, and stay ahead of future compliance requirements.
